Terms of Service

These are the rules for using Dialect360. We've written them in plain English so you actually know what you're agreeing to. Please read them carefully.
1. Acceptance of Terms
By creating an account, accessing, or using Dialect360 in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the platform. These terms apply to all users — free, Premium, and Pro subscribers alike. If you are using Dialect360 on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
2. Your Account
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information when registering. You must not share your account with others or allow others to access the platform through your credentials. You must notify us immediately at support@dialect360.com if you suspect any unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these terms.
3. Acceptable Use
You agree not to: (a) attempt to reverse-engineer, decompile, or scrape the platform or its content; (b) use automated bots, scripts, or tools to complete lessons or interact with the AI tutor; (c) use the AI tutor to generate harmful, abusive, or illegal content; (d) resell, sublicense, or redistribute platform content without written permission; (e) attempt to circumvent subscription restrictions or access paid features without a valid subscription; (f) upload or transmit malicious code, viruses, or any content that could harm the platform or other users; (g) impersonate any person or entity or misrepresent your affiliation with any person or entity.
4. Subscriptions & Billing
Paid plans are billed in advance on a monthly or annual basis as selected at checkout. All fees are non-refundable except as expressly stated herein. You may cancel your subscription at any time from your account settings — your access will continue until the end of the current billing period, after which it will not renew. We reserve the right to change pricing with at least 30 days' notice. If you dispute a charge, contact us at support@dialect360.com before initiating a chargeback. Fraudulent chargebacks may result in account termination.
5. Free Plan Limitations
The free plan is provided as-is and may be modified or discontinued at any time. Free plan users are limited to 5 lessons per day, basic AI tutor access, and up to 3 languages. We reserve the right to adjust free plan limits at any time with reasonable notice.
6. Intellectual Property
All content on Dialect360 — including but not limited to lessons, audio recordings, exercises, AI-generated responses, software, trademarks, and visual design — is owned by Dialect360 or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your personal, non-commercial language learning. You may not copy, reproduce, distribute, modify, or create derivative works from our content without prior written permission.
7. User-Generated Content
If you submit feedback, suggestions, or other content to us, you grant Dialect360 a worldwide, royalty-free, perpetual licence to use, reproduce, and incorporate that content into the platform without compensation to you. You represent that you own or have the right to submit any content you provide.
8. AI-Generated Content
Dialect360 uses AI models (including OpenAI GPT-4o-mini and Whisper) to power certain features. AI-generated content may occasionally be inaccurate, incomplete, or inappropriate. You should not rely solely on AI-generated translations or grammar corrections for professional, legal, or medical purposes. We are not liable for errors in AI-generated content.
9. Disclaimer of Warranties
Dialect360 is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. Language learning results vary significantly by individual effort, consistency, and prior experience — we make no guarantees regarding fluency outcomes.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Dialect360 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform. Our total aggregate liability to you for any claims arising from these terms or your use of the platform shall not exceed the total amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account at any time, with or without notice, for violations of these terms, fraudulent activity, abuse of the platform, or any other reason at our sole discretion. Upon termination, your right to use the platform ceases immediately. You may delete your account at any time from your profile settings. Sections 6, 9, 10, and 12 survive termination.
12. Governing Law & Disputes
These terms are governed by applicable law. Any dispute arising from or relating to these terms or your use of Dialect360 shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration against Dialect360.
13. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Your continued use of the platform after the effective date constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the platform and may delete your account.
